A1 Zoning Board of Appeals Overview, Darrin Derosia, Esq. and Patricia Burke, NYSDOS

An overview of the powers and duties of ZBAs and how they function with enforcement officials, the municipal planning board, and county planning agencies. The statutory requirements relating to the issuance of use and area variances, and ruling on zoning interpretations, board procedures and findings are discussed. (2 CEO and 2 CLE credits)

B1 Sustainable Local Governments, Rochelle Bell, Monroe County Department of Planning & Development

As local governments anticipate and adjust to economic, social and environmental challenges, they look for and create sustainable policies, programs and initiatives.  The “STAR Community Index” is currently under development with the goal of becoming the nationally recognized standard for planning and evaluating local government action for sustainability.  In the mean time, many sustainability initiatives are underway at the state, county and local level.

C1 US Army Corps of Engineers Wetland Program: What Local Governments Need to Know, Diane Kozlowski and Judy Robinson, US Army Corps of Engineers

Presentation will include an overview of the USACE regulatory authority under Section 404 the Clean Water Act and Section 10 of the Rivers and Harbors Act of 1899.  Primary focus will be an interactive session to discuss benefits of Corps input on local government decisions, pre-application meetings, assistance with permit applications, and differences in federal and state jurisdictions as it pertains to wetlands and streams.

B2 Sustainability through Community Planning and Design, Matt Ingalls, Ingalls Planning & Design and Thomas M. Robinson, Environmental Design & Research

How can municipalities integrate the broad concept of “sustainability” into their day-to-day projects, policies or regulations?  What steps can municipalities take right now to encourage sustainable practices locally?  This session seeks to provide examples of how sustainability can be efficiently integrated into local practice and will illustrate some of the innovative green infrastructure projects that are occurring in our own back yard in the G-FL region, big and small.

Latest developments in the courts in the area of land use and trends in decision making, how judicial decisions in other parts of the state impact local planning boards, ZBAs, and governing boards. (1 CLE credit)

C2 Dockings and Moorings Regulations, Diane Kozlowski and Judy Robinson, U.S. Army Corps of Engineers, Tom Kicior, G/FLRPC

This presentation will provide an overview of regulatory authority, permit requirements and permit review considerations for various types of docking and mooring proposals from the perspectives of both the U.S. Army Corps of Engineers and the NYS Office of General Services.

B3 EFC Funding for Green Approaches to Meet Clean Water Infrastructure Needs, J.C. Smith, Environmental Facilities Corporation

The Environmental Facilities Corporation (EFC) administers one of the most successful State Revolving Fund (SRF) Programs in the nation.  Since 1990, EFC has provided almost $11 billion in low-cost financing and grants for over 1,300 clean water infrastructure projects across the State. This session is an overview of funding opportunities and highlights of green approaches and solutions to meet clean water infrastructure needs.

A3 Municipal Regulation of Wind Energy Facilities, Patricia Burke and Erin Thomas, NYSDOS

Explores the potential of local laws to regulate both large and small wind energy systems, with a discussion of environmental, aesthetic, and other issues of interest to local governments, and a review of applicable state and federal regulations relating to wind energy systems

B4 Roundabouts - Who, What, When, Where, and Why?, Howard McCulloch, Roundabout Design Unit, NYSDOT Design Services Bureau

This presentation will cover the history of circular intersections, quantify the safety and capacity improvements that are possible with roundabouts as compared to more traditional intersection types, discuss potential locations for roundabouts, and address common misperceptions regarding roundabouts.  A simple level of service (LOS) capacity analysis method that only takes a few minutes looking at turn counts will be presented and an easy step-by-step procedure to develop a 2D layout in computer aided design (CAD) will be demonstrated.

C3 Clean Energy Grants and Incentives for Your Community, Larry Simpson, Blue Springs Energy

Presenter will provide an overview of clean energy (e.g.. efficient buildings/fleets, renewable energy, demand response, green energy) and Federal, NY State, utility, and other grants/incentives available to local governments.  Presenter will also discuss program for hosted local government website to communicate and educate clean energy incentives for residents, businesses, and non-profit organizations.

C4 Site Plan Review for Erosion and Sediment Control and Stormwater Management Concerns, P.J. Emerick, Ontario County Soil & Water Conservation District

The session will discuss what a municipal Stormwater Pollution Prevention Plan (SWPPP) reviewer should consider when reviewing a SWPPP and considerations when conducting a weekly site inspection. The session will briefly cover the stormwater permit, installation of different stormwater best management practices (BMP's) and site inspection do's and don'ts.

An overview of the powers and duties of local planning boards and commissions. Administrative and regulatory roles of the planning board are discussed, including comprehensive planning, site plan review, special use permits, subdivision review; the role of the board in making recommendations to the ZBAs; the importance of board procedures; referral to the county planning agency; and making legally defensible decisions. (2 CEO and 2 CLE credits)

B5 Main Street LLC: Community Entrepreneurism and the Case for Private Sector Rehab, Rick Hauser, In.Site: Architecture

This session will speak about the imperative of "community entrepreneurism," with a focus on the steps involved and the nuts and bolts of buying and rehabilitating downtown buildings.

C5 Options for Local Government Consolidation and Service Delivery Efficiency, Kyle Wilber and Sean Maguire, NYSDOS

In order to increase community competitiveness and provide leadership in these challenging economic times, local governments throughout NYS are identifying and implementing options to modernize local service delivery and reduce local costs.  The Local Government Efficiency (LGE) program at the NYS Department of State (DOS) provides financial and technical assistance to municipal leaders to develop and implement options for efficiency. 

This session will begin with an overview of local government consolidation.  The LGE program is currently working with many municipalities to assess the potential benefits of and limitations to local government consolidation.  We see some municipalities moving forward in their consolidation efforts, while others have moved to implement alternatives to reduce costs existing outside of consolidation.  In the second half of the session, DOS staff will discuss alternatives to consolidation and the development of service delivery options as a way to reduce local costs.  Specific examples will be provided that follow municipalities through the consolidation planning process to implementation, illustrating differing outcomes.
