Genesee/Finger Lakes Regional Planning Council developed and provided a Non-Air Environmental Scan as part of the to the Long Range Transportation Plan to the regional Metropolitan Planning Organization (MPO) - Genesee Transportation Council - that satisfies the newly enacted Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU) Title III, Section 3005 (Amending Section 5303), Subsection (i) Development of Transportation Plan, (B) Mitigation Activities.

The FHWA and the FTA have jointly issued proposed revisions of regulations governing the development of metropolitan transportation plans (LRTPs) and programs for urbanized areas.  This proposed revision results from the recent passage of the Safe, Accountable, Flexible, Efficient Transportation Equity Act: A Legacy for Users (SAFETEA-LU).

Part of the proposed revisions require “Environmental Mitigation Activities in Metropolitan Transportation Plans: Metropolitan Transportation Plans shall include a discussion of potential environmental mitigation activities, to be developed in consultation with Federal, State, and Tribal wildlife, land management, and regulatory agencies.  Environmental mitigation activities means strategic policies, programs, actions and activities that, over time, will serve to avoid, minimize, rectify, reduce, or compensate for the impacts to or disruption of elements of the human and natural environment associated with the implementation of a long-range transportation plan.  The environmental mitigation activities are intended to be regional in scope, even though the mitigation may address potential project-level impacts. “ (Department of Transportation Federal Highway Administration 23 CFR Parts 450 and 500 Federal Transit Administration 49 CFR 613 Statewide Transportation Planning; Metropolitan Transportation Planning; Proposed Rule)

The Genesee/Finger Lakes Regional Planning Council in association with the Genesee Transportation Council provided a report on the issues, potential mitigation activities and their benefits and impacts, and partners as it relates to the transportation non-air environmental portion of the proposed rule.
